Privacy Notice for Website Visitors

Pursuant to Law No. 6698 on the Protection of Personal Data (“KVKK”)

As GKC Partners, we prioritize the protection and security of your personal data processed as a data controller (veri sorumlusu), as defined under Law No. 6698 on the Protection of Personal Data ("KVKK" or "the Law"), through our website www.gkcpartners.com. For this reason, we aim to inform you within the scope of this Privacy Notice, which has been prepared in accordance with Article 10 of the KVKK.

1. Purposes of Processing Your Personal Data

Your personal data is processed in accordance with the Law, the relevant secondary regulations, and the decisions of the Turkish Personal Data Protection Authority for the purposes and legal bases stated below:

Communication: We may contact you using the personal data you provide to GKC Partners for various purposes. This includes sending reminders and notifications, as well as responding to messages you submit to us.

Legal Requirements: If required by any legal regulation to which www.gkcpartners.com is subject, your personal data may be processed, transferred, and stored for the duration set forth in the relevant legislation or as necessary for the relevant purpose.

Dispute Resolution: GKC Partners may process your personal data in order to demonstrate that it has acted in accordance with the Law and fulfilled its legal obligations in the event of any future disputes, and to resolve such disputes. In this context, your personal data may be shared with the relevant legal authorities.

Improving Services: Your personal data may also be processed for the purpose of conducting analytical activities to improve your experience on www.gkcpartners.com, evaluating your requests, complaints, and suggestions, and taking actions to enhance customer satisfaction and service quality.

In addition to the above, your personal data may also be processed for the following purposes:

  • Providing legal consultancy and attorney services to clients, and communicating with clients and third parties on behalf of clients within the scope of these services;
  • Issuing freelance attorney invoices and conducting payment, accounting, and reconciliation processes;
  • Managing internal operations such as finance, information technologies, human resources, office management, secretariat, correspondence, archiving, and similar;
  • Providing necessary information and documents to judicial and administrative authorities, including enforcement offices and law enforcement agencies, in accordance with requests that may arise under the relevant legislation; and
  • Fulfilling GKC Partners' obligations under applicable laws and regulations, primarily including the Attorneys' Act No. 1136.

2. Legal Bases for Processing Your Personal Data

Your personal data may be processed, to the extent necessary, for the legal consultancy/attorney services we provide to our clients, for our business development and procurement processes, as well as for GKC Partners' administration, management, and financial operations, as stipulated in Article 5/2(c) of the KVKK, where it is directly related to the establishment or performance of a contract; under Article 5/2(d) of the KVKK, where personal data has been made public by you; under Article 5/2(e) of the KVKK, where processing is necessary for the establishment, exercise, or protection of a right; or under Article 5/2(f) of the KVKK, where processing is required for the legitimate interests of the data controller GKC Partners, provided that it does not harm your fundamental rights and freedoms. Where necessary, your personal data may also be processed based on your explicit consent.

Your personal data may also be processed based on the legal ground set out in Article 5/2(e) of the KVKK, where processing is necessary for the establishment, exercise, or protection of a right, for the purpose of conducting legal processes. Furthermore, for the fulfillment of our obligations arising from the legislation in force, primarily including the Attorneys' Act No. 1136, and in response to information and document requests from competent authorities, your personal data may be processed in accordance with Article 5/2(ç) of the KVKK, which allows processing for compliance with a legal obligation. Additionally, data may be processed under Article 5/2(f), if necessary for the legitimate interests of GKC Partners as the data controller.

3. Transfer of Personal Data

Your personal data may be shared with the relevant institutions and organizations for the purpose of completing the transactions you carry out via www.gkcpartners.com and for their evaluation and management by GKC Partners. In addition, your personal data may be shared with GKC Partners' business partners and, where necessary for the fulfillment of legal obligations, with public institutions and organizations, under the conditions specified in Articles 8 and 9 of the Law.

In cases where personal data will be transferred abroad, GKC Partners may transfer your personal data in accordance with Article 9 of the Law.

4. Methods of Collecting Personal Data

www.gkcpartners.com may collect your personal data via electronic means in the scope of the services provided and the data processing purposes stated above, through communication channels such as call centers and e-mail, and through all types of input fields, comment boxes, response sections, and other forms available on gkcpartners.com, as well as through the relevant analytical tools. Additionally, your personal data may be collected through the cookies used on www.gkcpartners.com.

5. Your Rights

If you submit a request regarding your rights as a personal data subject, GKC Partners will process your request free of charge and respond as soon as possible, and no later than thirty (30) days depending on the nature of the request. However, if the process entails an additional cost, a fee may be charged in accordance with the tariff determined by the Turkish Personal Data Protection Board.

In this context, you have the right to:

  • Learn whether your personal data is being processed,
  • Request information if your personal data has been processed,
  • Learn the purpose of the processing and whether it is used in accordance with its purpose,
  • Know the third parties to whom your personal data has been transferred domestically or abroad,
  • Request correction of personal data if it is incomplete or incorrect, and request that such correction be notified to third parties to whom the data has been transferred,
  • Request deletion or destruction of your personal data in accordance with the conditions set forth in the Law, and request that such deletion or destruction be notified to third parties to whom the data has been transferred,
  • Object to a result against you that arises from the exclusive analysis of your personal data by automated systems,
  • Request compensation if you suffer damages due to unlawful processing of your personal data.

To exercise your rights regarding the processing of your personal data, you must submit your application to GKC Partners by completing the application form available on GKC's website and delivering it either in writing or through your registered electronic mail (KEP) address, secure electronic signature, mobile signature, or your email address that you previously provided and is registered in our system.

Depending on the nature of your request and the method of application, GKC Partners may require additional verification (such as sending a code to your registered phone number or calling you) in order to determine whether the application belongs to you and to protect your rights.
